Terms of Service

1. Publisher of the service

Tech CRM is published and operated by Technopek Group, a marketing agency headquartered in Agadir, Morocco (offices in Agadir and Casablanca). The service is available at https://crm.technopek.com.

2. Purpose and description of the service

Tech CRM is an online (SaaS) lead management platform for businesses. It brings together in a single workspace:

• A unified inbox that gathers the WhatsApp Business, Facebook Messenger and Instagram conversations of the channels the customer connects themselves.
• A lead pipeline with configurable statuses, records, notes and attachments.
• An appointment calendar and follow-up reminders.
• A quotes and invoices module.
• A landing page editor with forms and campaign tracking.
• Acquisition and team performance statistics.

3. Changes to the service

The service evolves: features may be added, changed or removed. A change that reduces an essential feature is announced in advance to the administrators of the workspaces concerned, by email and inside the application.

4. Eligibility

The service is reserved for business users aged 18 or over who have the legal capacity to enter into a contract. It is intended neither for consumers nor for minors.

By creating an account you confirm that you are acting on behalf of a company or a professional activity and that you have the authority to bind it.

5. Account, password and security

Where Technopek Group creates and administers a workspace for a customer as part of an engagement, the agency holds an administration access to that workspace, limited to what the agreed engagement requires.

• The information provided at sign-up must be accurate and kept up to date.
• You are responsible for keeping your password confidential and for everything done from your account.
• An account is personal: sharing credentials between several people is forbidden, one user must be created per team member.
• Any unauthorised access must be reported immediately to contact@technopek.com.

6. Acceptable use

Tech CRM must not be used to:

• Send unsolicited, bulk or misleading messages.
• Distribute unlawful, hateful, violent or defamatory content, or content infringing the rights of a third party.
• Offer products or services forbidden by Moroccan law or by the rules of the connected platforms.
• Attempt to access another customer's workspace, bypass a technical limit, probe or attack the infrastructure.
• Resell, rent or make the service available to a third party without the written agreement of Technopek Group.
• Import contact lists obtained without the consent of the people concerned.
• Automate sending at an abnormal rate or circumvent the limits of a connected platform.

7. Compliance with Meta platform rules

When you connect a WhatsApp Business channel, a Facebook Page or an Instagram account, you remain bound by Meta's rules in addition to these terms. You undertake in particular to comply with:

• The WhatsApp Business Messaging Policy and the WhatsApp Business Solution Terms: prior consent of the recipient, compliant use of message templates, respect for the permitted categories.
• The Meta Platform Terms and the Developer Policies applicable to Facebook and Instagram.
• Meta's advertising policies where your campaigns feed the CRM.

8. Consequences of a breach of platform rules

In the event of a breach, Meta may restrict or remove your phone number, your Page or your account, independently of us and without us being able to object. Technopek Group may in turn suspend the channel concerned in order to protect the service and its other customers.

9. Recipient consent and anti-spam

• You may only message a person who contacted you first, or who agreed to be contacted, and you must be able to evidence that agreement.
• Every marketing message must allow the person to ask for the sending to stop, and such a request must be honoured immediately.
• Purchased, rented or non-consented lists are forbidden.

10. Your data and your content

You remain the owner of the data you enter and of the content you publish with Tech CRM. You grant us only the technical licence required to host, display, back up and process that data in order to provide the service.

You are responsible for the lawfulness of the data you import, in particular for the consent of the people concerned.

11. Intellectual property

The Tech CRM software, its code, its interface, its visual identity, its documentation and its brand belong to Technopek Group. These terms transfer no ownership right to you: they grant a personal, non-exclusive and non-transferable right of use for the duration of your subscription.

Any copying, decompilation or reproduction of the service outside the cases allowed by law is forbidden.

12. Billing and payment

• The financial terms (plan, volume, price per delivered lead or subscription, currency, payment dates) are those of the quote or contract signed with Technopek Group.
• Invoices are issued from Tech CRM and sent to the customer's billing email address.
• Non-payment may lead to access being suspended, after a written reminder has gone unanswered.
• Taxes applicable in Morocco are added to the agreed amounts where they are due.

13. Term, suspension and termination

• The contract runs for the agreed term and continues until one of the parties ends it.
• You may stop using the service at any time and ask for your workspace to be deleted, from Settings or by email.
• Technopek Group may suspend an account in the event of a serious breach of these terms, of a threat to the security of the service, or of a requirement from a connected platform or an authority.
• Except in the case of serious misconduct, a suspension is preceded by a written warning and a reasonable period to put things right.
• After the contract ends, the workspace data is deleted within 30 days, except for accounting records kept for the period required by law.

14. Availability and warranties

We do what is needed to keep the service available, but we do not guarantee uninterrupted availability: outages may occur for maintenance, updates, an incident at our host or at a connected platform.

The service is provided as is. Tech CRM guarantees neither a number of leads, nor a conversion rate, nor the availability of Meta's interfaces, which remain under Meta's exclusive control. Any commercial commitments are those of the contract signed with Technopek Group.

15. Limitation of liability

Technopek Group is liable for direct damage resulting from its own breach, up to the amounts actually paid by the customer over the twelve months preceding the triggering event.

Technopek Group is not liable for indirect damage such as loss of revenue, loss of customers or reputational harm, nor for the consequences of a decision taken by Meta about your phone number, your Page or your account.

None of these limits apply in the event of gross negligence or wilful misconduct, nor where Moroccan law forbids them.

16. Changes to these terms

These terms may be amended. The version in force is the one published on this page, with its update date. Any substantial change is announced to the administrators of the workspaces concerned, by email and inside the application, before it takes effect. Continuing to use the service after that date means acceptance.

17. Governing law and jurisdiction

These terms are governed by Moroccan law, in particular law 09-08 on the protection of individuals with regard to the processing of personal data.

Failing an amicable settlement, any dispute about their validity, interpretation or performance falls within the jurisdiction of the courts of Agadir, Morocco.
